CLAIMS PROCESS
A claims office--known as the Waxler Claims Office--has been set up where Class Members can submit their claims via United States mail, postage prepaid. The mailing address of the Waxler Claims Office is P.O. Box 2002, Chanhassen, MN 55317-2002. Claims must be mailed to the Waxler Claims Office and must be postmarked on or before November 9, 2007. The Court Appointed Disbursing Agent (“CADA”) has proposed exactly what you will need to provide to prove your claim and receive compensation. Thus, you must use the proof of claim form prepared by the CADA in order to file a valid claim and notify the CADA of the compensation option that you have selected for each of your Affected Barges. You may obtain the approved proof of claim form by calling 1-877-722-9002 or going to the link provided on this page.
The CADA also will review each timely submitted claim and determine how each Class Member is to be compensated based on the claim submitted and the compensation protocol set forth in the Settlement Agreement. If you timely submit a valid claim, the CADA will send you a letter to tell you the compensation you are to receive, what else you may need to do in order to be compensated, etc. The Court will decide in a separate hearing the compensation each Class Member who files a valid claim is to receive.
If you are entitled to settlement compensation, following the Court’s compensation hearing, the CADA will send you a Certificate for Monetary Compensation or New Barge Discount, if applicable, and tell you what else you may need to do in order to be compensated.
Each Class Member who is to receive any compensation from the settlement will be required to sign a release document, as more fully described in the Settlement Agreement.
